Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using Astero Arena ("the Game", "the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Omniscient Sarl ("we", "us", "our"), a company registered in Switzerland.

2. Service Description

Astero Arena is a free-to-play mobile arcade game available on iOS and Android platforms. The Game may include optional in-app purchases that allow you to acquire virtual items, currency, or other content within the Game.

We reserve the right to modify, update, suspend, or discontinue the Game or any part of it at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Eligibility

You must be at least 13 years of age to use Astero Arena. If you are under 18, you represent that you have obtained the consent of a parent or legal guardian to use the App and agree to these Terms. By using the App, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

Certain features of the Game may require you to create an account or sign in through a third-party service. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account at our discretion if we suspect any unauthorized use or violation of these Terms.

5. Intellectual Property

All content in Astero Arena, including but not limited to graphics, artwork, text, audio, music, game mechanics, user interface design, logos, trademarks, and software code, is the exclusive property of Omniscient Sarl or its licensors and is protected by Swiss and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract the source code
• Remove, alter, or obscure any proprietary notices or labels
• Use the App for any commercial purpose without our written consent

6. User Conduct

When using Astero Arena, you agree not to:

• Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software
• Interfere with or disrupt the Game servers, networks, or other players' experience
• Harass, threaten, or abuse other users in any way
• Impersonate any person or entity, or misrepresent your identity
• Engage in any activity that violates applicable laws or regulations
• Attempt to gain unauthorized access to the Game or its systems
• Buy, sell, trade, or otherwise transfer your account or virtual items outside of the Game

Violation of these rules may result in temporary or permanent suspension of your account without prior notice.

7. In-App Purchases and Virtual Items

Astero Arena may offer in-app purchases for virtual currency, items, or other content ("Virtual Items"). By making an in-app purchase, you acknowledge that:

• Virtual Items have no real-world monetary value and cannot be exchanged for real currency
• All purchases of Virtual Items are final and non-refundable, except as required by applicable law
• Virtual Items are licensed to you, not sold, and we reserve the right to manage, regulate, modify, or remove Virtual Items at our discretion

8. Advertisements

Astero Arena may display third-party advertisements, including banner ads, interstitial ads, and rewarded video ads. By using the App, you acknowledge that advertisements are part of the free-to-play experience. You may interact with advertisements at your own discretion and risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Omniscient Sarl and its directors, officers, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Any loss of data, profits, goodwill, or other intangible losses
• Any damages resulting from unauthorized access to or alteration of your transmissions or data
• Any interruption or cessation of the Game service

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to indemnify, defend, and hold harmless Omniscient Sarl and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or in connection with your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to Astero Arena immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the App will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the use of Astero Arena shall be subject to the exclusive jurisdiction of the courts of Lausanne, Switzerland.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.

14. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will notify you by posting the updated Terms within the App and updating the "Effective Date" at the top of this page. Your continued use of the App after any changes constitutes acceptance of the new Terms.
